Terms of business

These are the terms KS Media works to. Each project's proposal or contract sets out its own scope and price; where it says something different, the proposal or contract wins.

Who you're dealing with

KS Media is a trading name of Kirishoban Sanjeevvijay, sole trader, Feltwell, Norfolk. KS Media is not VAT registered, so no VAT is added to its prices.

Quotes and prices

  • Prices on this site are starting prices for a typical project.
  • After a first call you get a one-page proposal with three options and a fixed price for each. A quote stands for 30 days.
  • Work outside the agreed scope is quoted before it starts. Nothing extra is charged without your agreement.

Paying

  • Projects are paid half on signing and half at launch.
  • Monthly work (retainers and care plans) runs for three months, then rolls on monthly. Either side can end it with 30 days' notice.
  • Invoices are due within 14 days.

Lost Quote Recovery

The fee is a share of the gross profit on orders from the agreed quote list that are placed within 90 days of the start: 10% for the first three clients, then 20%. Each order is matched to its quote number in your own accounts, and how gross profit is worked out is agreed in writing before day 1. No orders from the list, no fee.

The Sprint guarantee

The Growth Strategy Sprint is paid half on booking. If it doesn't end in a plan you would act on, tell KS Media within 7 days of the final session and the second half isn't paid. If you sign a retainer within 30 days, the Sprint fee is credited against your first retainer invoices until it is used up.

Who owns what

Once a project is paid in full, you own the finished designs, copy and site written for you. Third-party items (fonts, photos, plugins and services) stay under their own licences, and KS Media tells you which ones a project uses. KS Media keeps its own tools, templates and know-how.

Showing the work

KS Media asks before showing your work, your name or any result in its portfolio, and shows only what you agree to in writing.

Your part

Projects run on time when content, logins and feedback arrive when agreed. If they're held up for more than 30 days, KS Media may invoice the work done so far.

Liability

KS Media's liability for any project is limited to the fees paid for it. Nothing here limits liability that the law does not allow to be limited.

Law

These terms are governed by the law of England and Wales.
